A masterclass in subverting parliamentary democracy and the will of the people, this is a leaked draft framework for the IGC on the Constitutional Treaty, beginning in July, to be agreed at tomorrow’s Berlin summit.
The document has been circulated to the EU27 member states outlining the issues it believes need to be dealt with over the coming days. It suggests repackaging the salvaged elements of the Constitution as the ‘Reform Treaty’, renaming the Foreign Minister and limiting the role of the EU in foreign policy as well as dropping the very symbols of the EU, such as the flag and anthem, which are ironically almost universally accepted by European citizens. As widely suspected, both here and elsehwhere, significant concessions and opt-outs in the area home affairs (justice and policing) are suggested in an effort to placate the UK as Tony Blair prepares to hand Gordon Brown this particular poison chalice. According to this framework for negotiations, the commission and parliament will not get any new powers. The Charter of Fundamental Rights will be limited to a single article, which makes it legally binding and sets out its scope. Interestingly, there is to be a new article on member states’ social security systems, stating that if a country fears the scope, cost of financial structure” of their welfare system will be affected they can refer the matter to the European Council. As reported in the EU Observer, an EU official remarked that the “Reform Treaty” - as it is to be known - is now “unbelievably ugly” and will be “not at all clear to citizens”.
